Islamabad(Profile Facts)—Chief Justice of Pakistan Justice Iftikhar Muhammad Chaudhry on Thursday ordered the owners of the Sahowal rental power plant (RPP) to return the advance payment of Rs780 million along with interest to the national exchequer.
A three member bench that also included Justice Ghulam Rabbani and Justice Khalilur Rehman Ramday gave the orders after National Electric Power Regulatory Authority (Nepra) counsel Najamul Hasan Kazmi presented a detailed report on the RPP.
The Chief Justice made it clear that the court will not let technicalities hinder the return of money from the projects which have failed to comply with their agreements.
Pakistan Electric Power Company (Pepco) counsel Khwaja Tariq Raheem informed the bench that earlier, Young Generation Company had returned the advance payment after it failed to make its rental power project operational.
In a more recent case, the Central Power Generation Company, acting on the directives of the ministry of water and power, had paid $21 million in advance to Walters Power International Limited. The Supreme Court, after taking suo motu notice of the irregularity first reported in The Express Tribune, succeeded in retrieving the money.
